Terms and Conditions of Renting Sala 113

§1. General provisions

The entity managing the space „Sala 113” is Fundacja Dusha (Dusha Foundation), ul. Ogrodowa 10/1a, NIP: 7123470511, REGON: 527763661, hereinafter referred to as the Lessor.

Individuals or entities under commercial law using the space are referred to as the Lessee.

The primary purpose of the space is to host workshops, events, and meetings.

Use of the space for other purposes requires the Lessor's consent.

§2. Rules for use of the space

The space is provided together with basic equipment: tables, chairs, projector, and audiovisual equipment.

Equipment must be used in accordance with its intended purpose.

The Lessee is obliged to maintain order and return the space in a condition no worse than at handover.

Smoking (traditional cigarettes, e-cigarettes, and other tobacco products) and consumption of alcohol are strictly prohibited on the premises of Sala 113, unless the Lessor has given written consent.

Removing equipment from the space without the Lessor's consent is prohibited.

§3. Liability

The Lessor provides the space in full working order.

The Lessee is liable for any damage arising during use of the space, including that caused by third parties.

Any damage must be reported to the Lessor without delay. Failure to report damage or improper return of the space (e.g. leaving a mess, condition worse than at handover) is subject to a contractual penalty under §4.

§4. Contractual penalties

Violation of the smoking ban obliges the Lessee to pay a contractual penalty of 500 PLN.

Consumption of alcohol without the Lessor's consent incurs a penalty of 300 PLN.

Removing equipment from the space without the Lessor's consent incurs a contractual penalty of 200 PLN.

Improper return of the space (mess, condition worse than at handover) or failure to report damage to the Lessor incurs a contractual penalty of 200 PLN.

Damage to equipment obliges the Lessee to cover the full cost of repair or replacement.

Penalties are charged for each identified violation; in the case of simultaneous violation of several provisions, penalties are summed.

Contractual penalties are payable within 14 days of the Lessee receiving a demand for payment (e.g. by email to the address provided at the time of booking).

Violations are documented by the Lessor (in particular by protocol, photographs), which constitutes the basis for imposing a penalty.

The Lessor reserves the right to terminate the rental immediately in the event of a gross violation of the regulations – without refund. A gross violation is understood to include in particular: serious threat to safety, persistent breach of the smoking or alcohol ban, intentional damage to property, conduct inconsistent with the intended use of the space, or other conduct that prevents continued use of the rental.

§5. Bookings and payments

The price list is available on the Lessor's website.

Bookings may be made by phone, email, or via social media.

Cancellation of a booking:

  • one day before: 50% of the price
  • on the day of the rental: 100% of the price

§6. Final provisions

Making a booking constitutes acceptance of these regulations.

The Lessor reserves the right to amend the regulations.
